Under Section 2(d) of the Act, a child is defined as any person below the age of 18 years. The law is entirely gender-neutral, meaning it applies equally to any child regardless of gender, and it explicitly states that a minor's "consent" is legally invalid in any sexual context.’

These include "aggravated" versions if the perpetrator is a person in a position of authority or trust, such as a family member, doctor, or teacher.

Under Section 35, the law mandates that a child's evidence be recorded within 30 days and the entire trial should ideally be completed within one year. While Pune’s Special Courts prioritize these cases for a "speedy trial," the actual timeline can vary depending on the complexity of medical evidence and the court's current backlog.

Under the POCSO Act (2012) and its 2019 Amendment, punishments are strictly categorized based on the severity and nature of the offense. For Penetrative Sexual Assault, the law mandates a minimum of 10 years in prison, which can extend to life imprisonment. In cases of Aggravated Penetrative Assault, such as those committed by persons in authority, the punishment starts at 20 years and can include the Death Penalty. Sexual Harassment carries a penalty of up to 3 years, while the storage or commercial use of Child Pornography is punishable by 3 to 7 years in prison.
